Partner Program Terms of Use and Agreement
Effective Date: July 13, 2026
This PredicTrader Partner Program Agreement ("Agreement") is entered into between PredicTrader LLC ("PredicTrader," "Company," "we," "our," or "us") and the individual or entity applying to or participating in the PredicTrader Partner Program ("Partner," "you," or "your").
By applying to, enrolling in, or participating in the PredicTrader Partner Program, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement.
1. Purpose
The PredicTrader Partner Program allows approved Partners to refer new customers to PredicTrader through an assigned Partner Link or Partner Code.
Approved Partners may earn recurring Revenue Share on qualifying subscription payments made by eligible referred customers in accordance with this Agreement.
Participation in the Partner Program does not create an employment relationship, partnership, franchise, joint venture, agency, or ownership interest between you and PredicTrader.
2. Eligibility
You represent and warrant that:
You are at least 18 years of age.
You have the legal authority to enter this Agreement.
All information provided is accurate and complete.
You will promptly update inaccurate information.
You will comply with all applicable laws.
Approval into the Partner Program is solely at PredicTrader's discretion.
3. Partner Account
You are responsible for maintaining:
Accurate account information
Secure login credentials
Current payout information
Account confidentiality
You are responsible for all activity under your account.
4. Partner Link and Partner Code
Each approved Partner receives:
One unique Partner Link
One unique Partner Code
These remain the exclusive property of PredicTrader.
PredicTrader may modify, replace, suspend, revoke, or regenerate these identifiers at any time.
5. Referral Attribution
PredicTrader uses a 90-day last-click attribution model.
Generally:
The last eligible Partner interaction before signup or payment receives credit.
Attribution expires after 90 days.
Existing customers generally cannot become new referrals.
Cross-device attribution cannot be guaranteed.
Attribution decisions are final.
6. Revenue Share
Revenue Share is earned only on:
Successfully collected subscription payments
Eligible subscriptions
Qualified referrals
Payments not refunded, reversed, disputed, or cancelled
Revenue Share equals:
Eligible Subscription Payment × Partner Revenue Share Rate
Taxes are excluded from the calculation.
Discounts reduce the eligible payment amount.
Failed payments generate no Revenue Share.
7. Revenue Share Rate
Unless otherwise agreed in writing, the standard Revenue Share Rate is 20%.
PredicTrader may modify future Revenue Share Rates at its sole discretion.
Changes do not affect previously approved earnings except to correct errors or fraud.
8. Pending Earnings
Revenue Share initially appears as Pending Earnings.
Pending Earnings may remain pending until payment verification, fraud review, refund periods, chargeback periods, or administrative approval have concluded.
Pending Earnings do not constitute money owed until approved.
9. Payouts
Eligible payouts are generally processed monthly after the 15th for the previous month.
PredicTrader may establish:
Minimum payout thresholds
Reserve balances
Verification requirements
Supported payout methods
Processing schedules
Balances below the minimum threshold may roll forward.
Partners are solely responsible for maintaining accurate payout information.
10. Taxes
Partners are solely responsible for:
Income taxes
Self-employment taxes
VAT
GST
Business taxes
Regulatory reporting
PredicTrader provides no tax advice.
PredicTrader may require tax documentation before issuing payments.
11. Prohibited Conduct
Partners may not:
Refer themselves
Create fake accounts
Purchase subscriptions through their own referral
Refer household members solely to generate commissions
Generate fake traffic
Manipulate cookies
Use bots
Use malware
Spam
Misrepresent PredicTrader
Guarantee trading profits
Guarantee investment returns
Mislead potential customers
Bid on PredicTrader trademarks in paid search advertising without written approval
Violations may result in:
Immediate suspension
Commission reversals
Account termination
Permanent disqualification
12. Marketing Guidelines
Partners must market PredicTrader honestly and professionally.
Partners shall not:
Misrepresent product features
Claim guaranteed income
Promise trading success
Suggest PredicTrader eliminates trading risk
Represent themselves as employees or official company representatives
13. FTC Endorsement Compliance (NEW)
If you promote PredicTrader in the United States or in any jurisdiction requiring disclosure of compensated endorsements, you agree to comply with all applicable advertising and consumer protection laws, including the rules and guidance published by the U.S. Federal Trade Commission (FTC).
You must clearly and conspicuously disclose that:
You are a PredicTrader Partner.
You may receive compensation if someone purchases through your Partner Link or Partner Code.
Your relationship with PredicTrader may influence your recommendation.
Examples of acceptable disclosures include:
"I may earn a commission if you purchase through my link."
"This post contains affiliate links."
"PredicTrader compensates me for qualifying referrals."
Disclosures must:
Appear near the recommendation.
Be easily noticeable.
Be understandable to ordinary consumers.
Not require clicking another link to view.
PredicTrader may remove or suspend any Partner who fails to comply with applicable endorsement disclosure requirements.
14. DMCA, Trademark and Brand Usage Policy (NEW)
PredicTrader owns all copyrights, trademarks, logos, graphics, software, documentation, marketing materials, website content, and other intellectual property.
Partners receive a limited, revocable, non-exclusive, non-transferable license solely for promoting PredicTrader.
Partners may not:
Modify PredicTrader logos.
Remove copyright notices.
Register confusingly similar domain names.
Register social media accounts impersonating PredicTrader.
Copy substantial portions of PredicTrader website content.
Claim ownership of PredicTrader materials.
Reverse engineer proprietary software.
Use PredicTrader trademarks in a misleading manner.
Create websites that appear to be official PredicTrader websites.
Partners agree to comply with the Digital Millennium Copyright Act (DMCA) and all applicable intellectual property laws.
PredicTrader may immediately revoke trademark permission at any time.
Unauthorized use may result in:
Immediate suspension
Termination
Legal action
Recovery of damages
Injunctive relief
15. No Investment Advice
PredicTrader provides software and educational tools only.
Nothing provided constitutes:
Financial advice
Investment advice
Trading recommendations
Legal advice
Tax advice
Trading futures, forex, stocks, options, and cryptocurrencies involves substantial risk.
Past performance does not guarantee future results.
16. Fraud Prevention
PredicTrader actively monitors:
Duplicate accounts
Shared payment methods
Device information
IP information
Chargebacks
Refunds
Abnormal referral patterns
PredicTrader may investigate any Partner at any time.
Failure to cooperate may result in suspension.
17. Adjustments and Reversals
Revenue Share may be reduced or reversed due to:
Refunds
Chargebacks
Fraud
Duplicate attribution
Administrative errors
Pricing corrections
Subscription cancellations
Negative balances may offset future earnings.
18. Restricted Countries and Sanctions Compliance (NEW)
Partners represent and warrant that they are not:
Located in any country or territory subject to comprehensive U.S. sanctions or trade embargoes.
Listed on any sanctions list maintained by the United States, including those administered by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC).
Acting on behalf of any sanctioned individual, organization, or government.
Partners agree not to use the PredicTrader Partner Program in violation of any applicable export control, trade restriction, sanctions, or anti-money laundering laws.
PredicTrader reserves the right to suspend or terminate any Partner account whenever required by applicable law or if sanctions compliance cannot be reasonably verified.
19. Termination
Either party may terminate participation at any time.
PredicTrader may immediately suspend or terminate any Partner for:
Fraud
Abuse
Misleading advertising
Policy violations
Legal concerns
Reputational concerns
Termination ends future Revenue Share eligibility.
Previously approved earnings remain subject to verification and adjustment.
20. Confidentiality
Partners shall not disclose confidential information including:
Business processes
Pricing strategies
Customer information
Software source code
Internal documentation
Financial information
This obligation survives termination.
21. Privacy
PredicTrader processes personal information in accordance with its Privacy Policy.
Partners agree to comply with applicable privacy laws.
22. Electronic Communications Consent (NEW)
By participating in the Partner Program, you consent to receive communications electronically.
PredicTrader may provide notices through:
Your Partner Dashboard
Website announcements
In-app notifications
Electronic notices may include:
Approval notices
Agreement updates
Revenue Share statements
Payment notifications
Tax requests
Security notices
Fraud investigations
Marketing compliance reminders
Program updates
Electronic communications satisfy any legal requirement that communications be provided in writing.
You are responsible for maintaining a current email address and regularly reviewing your Partner Dashboard.
Failure to receive notices because your contact information is outdated does not relieve you of your obligations under this Agreement.
23. Limitation of Liability
To the fullest extent permitted by law, PredicTrader shall not be liable for:
Lost profits
Lost revenue
Lost business opportunities
Indirect damages
Consequential damages
Incidental damages
Special damages
Punitive damages
PredicTrader's total liability shall not exceed the Revenue Share actually paid to the Partner during the twelve (12) months immediately preceding the event giving rise to the claim.
24. Disclaimer of Warranties
The Partner Program is provided "AS IS" and "AS AVAILABLE."
PredicTrader disclaims all express and implied warranties including merchantability, fitness for a particular purpose, uninterrupted availability, and non-infringement.
25. Indemnification
You agree to defend, indemnify, and hold harmless PredicTrader, its officers, employees, contractors, affiliates, successors, and assigns from any claims, losses, liabilities, damages, costs, and expenses arising out of:
Your participation in the Program
Your advertising or marketing
Your breach of this Agreement
Your violation of any law
Your negligent or wrongful acts
26. Modification of Agreement
PredicTrader may modify this Agreement at any time.
Material changes become effective upon posting on the website or delivery through email or the Partner Dashboard.
Continued participation constitutes acceptance of the revised Agreement.
27. Force Majeure
PredicTrader shall not be liable for delays or failures resulting from events beyond its reasonable control, including natural disasters, internet outages, payment processor failures, labor disputes, governmental actions, cyberattacks, or other force majeure events.
28. Governing Law
This Agreement shall be governed by the laws of the State of Nevada, without regard to conflict-of-law principles.
29. Dispute Resolution
The parties agree to first attempt good-faith negotiation before commencing litigation.
Unless prohibited by law, any legal action shall be brought exclusively in the state or federal courts located in Clark County, Nevada.
30. Severability
If any provision of this Agreement is determined to be unenforceable, the remaining provisions shall remain fully enforceable.
31. Entire Agreement
This Agreement, together with the Privacy Policy and any policies referenced herein, constitutes the complete agreement governing the PredicTrader Partner Program.
32. Contact Information
Questions regarding this Agreement may be submitted through the official contact methods published on the PredicTrader website.
33. Acceptance
By selecting "I have read and agree to the PredicTrader Partner Program Terms of Use and Agreement," submitting an application, or participating in the Program, you acknowledge that:
You have read this Agreement.
You understand this Agreement.
You agree to be legally bound by this Agreement.
You are legally capable of entering into this Agreement.
Electronic acceptance has the same legal force and effect as a handwritten signature.
